What the chamber accepts
Banking and recovery work is accepted on either side — for borrowers and guarantors resisting recovery, and for banks and financial institutions pursuing it.
Before the Debt Recovery Tribunal the chamber conducts original applications, securitisation applications under section 17 of the SARFAESI Act, and appeals to the Debt Recovery Appellate Tribunal. A borrower's remedy under section 17 arises as soon as any measure under section 13(4) is taken, which includes a possession notice — it is not necessary to wait for an auction to be announced.
Proceedings arising from classification of an account as non-performing, service of the demand notice under section 13(2), the reply to a representation under section 13(3A), and valuation and sale procedure are the points on which such matters are ordinarily decided.
